Terms and Conditions
This Plan is a legal contract. By purchasing it, You understand that it is such a contract and acknowledge that You have had the opportunity to read the terms and conditions set forth herein. These terms and conditions together with Your completed registration constitute the entire agreement. 1. DEFINITIONS: Throughout this Plan ("Plan") the words, "We", "Us", and "Our" refer to AIG Warranty Services and Insurance Agency, Incorporated ("AIGWS"). The words, "You" and "Your" refer to the Plan holder. "Product" refers to one (1) personal computer or laptop that is covered by this Plan. 2. TERM: This Plan becomes effective as of the date that You subscribe to the Plan. Billing begins as of the effective date and renews automatically from month to month until cancelled. 3. COVERAGE: Coverage under this Plan begins on day thirty one (31) after You have registered Your Product, unless stated otherwise in this section. This Plan supplements the manufacturer's warranty by providing certain additional benefits. After the expiration date of the manufacturer's warranty, this Plan continues to provide some of the manufacturer's benefits, as well as those listed within these terms and conditions. The Plan is offered on a per account basis and is available solely to Cincinnati Bell residential and small business telephone customers. This Plan covers qualifying products sold and residing in the United States only. (a) Repair or Replacement of Products; Warranty: Under this Plan, if Your equipment malfunctions or fails to operate as a result of normal use or a power surge, We will repair or replace Your Product. If We determine in our sole discretion that Your covered product cannot be repaired, or that the cost of repair would exceed the retail value of a replacement product, then We will replace it with a new or remanufactured product of like kind, and quality, subject to the Annual Value Limitation on Claims. Technological advances may result in a replacement product with a lower selling price than the original product. We make no representation that any replacement product will be identical or substantially identical to the product submitted for repair or replacement. AT OUR OPTION, REPLACEMENTS WILL BE NEW, REBUILT, OR NON-ORIGINAL MANUFACTURER'S PARTS OR PRODUCTS THAT PERFORM TO THE FACTORY SPECIFICATIONS OF THE ORIGINAL PRODUCT. We will warrant a replacement for ninety (90) days from the date You receive it. We will warrant a repair service for thirty (30) days from the date of repair completion. Coverage under this Plan continues after each repair or replacement. If We determine in our sole discretion that Your covered product can be neither repaired nor replaced, then We may require You to ship the defective Product to Us, at Your expense. In such event, we will issue a check made payable to You, or to a computer vendor You specify, for an amount based on the current market value of the Product. You can purchase a replacement Product and register it to continue this Plan. Coverage for the replacement will begin thirty one (31) days after its registration. Additional Products may be covered separately under their respective Plans. (b) On-Site Service: You must provide a safe, non-threatening environment for Our technicians. On-site service will be provided during regular business hours, local time, Monday through Friday, except holidays. Laptops will not be serviced on-site, but will either be carried in to an authorized service provider that We designate, or be shipped to a service center at Your expense. (c) Power Surge Protection: This Contract provides power surge protection in the absence of any other insurance coverage from the effective date of this Contract. (d) Digital Lifeline™ (DLL™): For each subscription, You will be authorized to download one copy of Digital Lifeline™ (DLL™) from Our website at www.cincinnatibellztcare.com. The installation of DLL™ is required for the registration process. On-line help-desk support begins immediately upon Product registration. 4. REGISTRATION: You must register the Product to be covered under this Plan. Upon subscription, You will be authorized to download one copy of Digital Lifeline™ (DLL™) from Our website. During the installation of DLL™, You will be prompted to register the computer on which DLL™ is installing. Failure to complete registration may result in a delay in coverage, as coverage is only provided after thirty (30) days from the successful registration of Your Product. Changes and/or updates to Your Product registration can be made over the Internet. A subscriber may have more than one Product, but each Product must be registered separately, and only one Product is covered per Plan. 5. ANNUAL VALUE LIMITATION ON CLAIMS: Under this Plan, You are limited to repairs and/or replacements equal to five hundred dollars ($500) in total retail value for all claims processed during the previous consecutive twelve (12)-month period. The retail value of any repair shall be equal to the market value of parts and labor used, as determined solely by Us, provided that such value shall not exceed the retail value of a comparable replacement Product. (a) Limitation of Liability: We will not be responsible for any data that is lost or damaged during a repair or replacement under this agreement. This Plan does not cover the cost of data recovery or any other consequential or incidental damages. WE WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST INCOME OR ANY SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF OUR PERFORMANCE UNDER THIS AGREEMENT. (6) PLAN HOLDER RESPONSIBILITIES: Your Product must be in good working condition prior to registration. Any faults detected during the initial registration of Your Product will be recorded as a pre-existing defect. You must follow the instructions that are in the owner's manual for proper use, care and maintenance of Your Product. Failure to follow the manufacturer's maintenance and service guidelines may result in the denial of coverage under this Plan. We strongly recommend (but do not require as a condition of this Plan) the regular back up of data and software. Please retain these terms and conditions for Your records. (a) Abuse of the Plan: This Plan Is for Your use only and may not be assigned. Products owned by anyone other than You may not be registered under the Plan. Any abuse of the Plan by You, including but not limited to seeking repair or replacement of a product not belonging to You, may result in termination of the Plan upon notice. 7. PAYMENT: Charges for the Plan are billed one month in advance. You agree to the pay monthly charges for this Plan as such charges may appear on Your Cincinnati Bell telephone bill. The monthly rate for the Plan was provided to You at the time You subscribed to the Plan. You may contact Your Cincinnati Bell representative for the current applicable rate for the Plan. Because this Plan is optional, non-payment of charges for this Plan will not cause termination or denial of Your regular telephone service. Non-payment will, however, result in cancellation of the Plan. All charges, plus all applicable taxes, shall be due and payable by the due date stated on Cincinnati Bell's bill. Payments received after that date may be subject to a late payment charge. There is a Service Order Charge of fifty dollars ($50.00) per Product each time You file a claim under this Plan unless the failure is due to the mouse, keyboard or speakers. This Service Order Charge will be collected via a valid credit card or check prior to authorization being provided. If the service charge is paid via check, the check must clear prior to the start of service and/or replacement. 8. CLAIMS PROCESS: In the event Your Product malfunctions after thirty (30) days from the registration of Your Product, You may file a claim either via the Internet at www.cincinnatibellztcare.com or by telephone at 1-866-410-6346. After We authorize Your claim, You may arrange for service and we will cover the reasonable cost of parts and labor that We authorize. Desktop computers will be serviced on-site. Repair service will be available Monday through Friday during regular business hours and will be provided by an authorized service provider. Laptops will be required to be delivered to and picked up from a service location that We designate. If a local servicer is not available, We will provide You with instructions for shipping Your laptop to a depot service location. All expenses related to packaging, shipping and insurance to the depot servicer are Your responsibility. This Plan will cover all expenses related to returning the repaired laptop back to You. 9. AVAILABILITY OF SERVICES: While We try to complete service as quickly as possible, We are not responsible for delays caused by factors beyond our control, including but not limited to manufacturer's delays, shipment to a service facility or acts of God. 10. INSURED SERVICE CONTRACT: This Plan is insured by the New Hampshire Insurance Company. This Plan is secured by a contractual liability insurance policy provided by New Hampshire Insurance Company, 175 Water St., 20th Floor, New York, NY 10038 and telephone number (800) 250-3819 or Warranty@aig.com. If You fail to receive a claim payment, service or a replacement product within 60 days of submitting the request, or You are otherwise dissatisfied, You may submit the claim directly to the insurance company. 11. EXCLUSIONS FROM COVERAGE: This Plan does not cover the following: (a) Acts of God, including but not limited to, floods, fires, earthquakes and the like, except that damage due to power surge is covered under this Plan; (b) Any part or material designed to be consumed during the life of the Product, such as batteries; (c) Computer peripherals (except keyboard, mouse and speakers), adjunct devices or any device that is not built into your computer's housing, such as monitors, printers, scanners, remotes, PCMCIA cards, and accessories; (d) Computers that are not registered with Cincinnati Bell, or are not running Digital Lifeline , or have been registered with Cincinnati Bell and running Digital Lifeline for less than 30 days;; (e) Computers that have already received repairs and/or replacements equal to or greater than five hundred dollars ($500) in total retail value during the previous consecutive twelve (12)-month period; (f) Costs due to routine maintenance, customer education, or no problem found; (g) Damage to, failures of, or defects in cosmetic or non-operational components that do not inhibit the proper operation and performance of a covered item, such as but not limited to: appearance parts; broken hinges; or decorative finishing; (h) LCD screens on laptops; (i) Macintosh computers or laptops; (j) Problems caused by abuse, misuse, improper installation, water damage or collision with any object; (k) Problems that are a result of the original manufacturer's design plan or manufacturing process (as determined solely by Us); (l) Products not equipped with a processor that is a Pentium II or newer, or its equivalent; or installed with a Microsoft operating system of Windows 98 Second Edition or higher (m) Products provided for public use or rental; (n) Repair or replacement covered by any other warranty, service agreement, insurance policy or manufacturer recall in effect at the time of the failure; (o) Special, indirect, consequential or incidental damage such as theft or loss of the covered Product; loss of use; or property damage; (p) Support or repairs to software; loss or damage to stored data or software due to any cause, including: computer virus; worm; Trojan program; adware, spyware, firmware or any other software program. 12. PLAN NOT TRANSFERABLE: This Plan is not transferable. This Plan may be transferred to another computer only if properly registered with Us. Transferred computers are subject to a 30-day waiting period. In the event You transfer Your Cincinnati Bell landline telephone service to another location within Cincinnati Bell's territory, retain Cincinnati Bell telephone service, and continue subscription to this Plan, there will be no lapse in coverage. 13. RENEWAL: This Plan automatically renews from month to month until cancelled. 14. CANCELLATION: This Plan is provided on a month-to-month basis and can be canceled by You at any time for any reason by notifying Cincinnati Bell's local business office (or other number that Cincinnati Bell may designate for such purpose). In the event You cancel this Plan, coverage under this Plan will end as of the date of cancellation. Cincinnati Bell may cancel the Plan upon 30 days written notice to You. 15.
